3.2       The DMO&S stated that the above members would leave the room when this item was being considered.

4.         The minutes of the meeting held on 12th September 2019 were confirmed as a correct record.

 

5.

Sanctions Guidance - Update / Canllaw ar sancsiynau - y diweddaraf pdf icon PDF 125 KB

5.1       The DMO&S presented a report to appraise members of the updated sanctions guidance available to the Ethics & Standards Committee in breaches of conduct reported to them and to note what considerations they should take into account to ensure that a sanction is reasonable and proportionate to the subject member’s behaviour.

 

5.2       Members noted that should they be asked to consider what sanctions may be applicable for any breach of the Code of Conduct reported to them by a Member, advance consideration of the sanctions in their broadest category will serve the Committee well in defining efficiently and effectively with the business before it.

 

5.3       Members ENDORSED the updated guidance from the Adjudication Panel for Wales on the factors to take into account in considering appropriate sanctions against Members who are found to breach the Code of Conduct.

 

 

 

6.

Code of Conduct - ICT Protocol - Amendment to the Constitution / Cod Ymddygiad - Protocol TGCh - Newid i'r Cyfansoddiad pdf icon PDF 373 KB

Minutes:

6.1       The DMO&S presented a report on amendments to the Code of Conduct for Councillors including the members ICT protocol for approval and subsequently onward submission to Council to form part of the Code of Conduct.

 

6.2       The Committee ENDORSED the amendments to the Code of Conduct for Councillors, including the ICT Protocol as set out in Appendix One of the report.

 

 

7.

7.1       The draft Annual report of the Ethics and Standards Committee was presented.

 

7.2       The Chair invited members to submit any suggested amendments as soon as possible.

 

7.3       Members NOTED that the report would be presented to Council in June 2019.

6.1       The DMO presented a report on councillors’ applications for dispensations to award Small Schemes’ monies where there is a prejudicial interest.

 

6.2      Councillor Ray Williams and Mrs Kathryn Pegington left the room during consideration of applications in which they had a prejudicial interest which had been declared under item 3.

 

6.3      In respect of Ponthir Community Council (PCC), the Committee were told that PCC has 7 Councillors, 5 of whom are members of the Sports Club (1 of which is also on the Sports Club’s committee) and 1 member whose children are members of the cricket club which has representation on the Sports Club’s committee. This leaves 1 Councillor who is not a member nor has an interest in the Sports Club. Therefore the Community Council currently does not have the minimum requirement of 3 Councillors to consider the grant request and make a decision. Therefore, 5 applications for dispensations were submitted and included on the list of applications for dispensation included in the list attached to the report.

 

6.4       The amounts to be awarded will be determined by the Community Council. Previously, grants awarded over the past two years were 2016/17 £300 and 2017/18 £300.

 

6.5       The Committee agreed to grant the Community Councillors named in the table a dispensation to consider awarding a Community Council grant to Ponthir District Sports Club.

 

6.6       Members applauded members of Ponthir Community Council for being open, honest and transparent in applying for dispensations.
